Arrest records in Bibb County are subject to the Georgia Open Records Act, which classifies arrest records as "public records" available for public inspection as part of the state's open government policy. State law, nonetheless, regards cumulative criminal histories differently: criminal history record information is strictly controlled under O.C.G.A. § 35-3-30 et seq.

Active Warrant Search in Bibb County

An arrest warrant can be approved by a magistrate after reviewing a police affidavit requesting authority to take someone into custody. Before signing a warrant, the magistrate must be satisfied that a suspect's degree of involvement in a crime necessitates the issuance of an arrest order. How to Find Arrest Records for Free in Bibb County

There are free online options for obtaining arrest records in Bibb County. The county government, specifically the Sheriff's Office, provides these tools. 

  • Sheriff's Office Inmate Search: This tool features a jail search by name and a rolling 24-hour booking record. This allows the public to find any recent arrestee in county custody. However, the system does not show historical arrests for people who have been bonded out or served their time. 
  • Bibb County OPRA Form: The public may use this online form to send in a formal request for an arrest or incident report. Depending on the type of record requested, the applicant may be charged 10 cents per page for copying, alongside other administrative costs. 

While these free channels provide basic public-facing data, people typically need to use alternative methods to obtain detailed police files or investigatory reports. 

Bibb County Arrest Report

In Bibb County, as elsewhere, a clear legal distinction exists between the function and accessibility of arrest records versus arrest reports. While the former encapsulates summary data on individuals taken into custody, the latter provides a detailed narrative of the factual circumstances of an arrest.

An arrest report is typically drafted by the officer present at the time of the incident. It spells out the factual circumstances, physical evidence, and probable cause for the arrest. 

While initial arrest reports are public documents according to O.C.G.A. § 50-18-72(a)(4), a detailed incident report or investigatory document is closed while a criminal investigation remains active. Once the case is officially concluded, the records become open but remain subject to standard redaction rules. 

How to Get an Arrest Record Expunged in Bibb County

Bibb County arrest records can be removed from public access via a legal process known as "record restriction." O.C.G.A. § 35-3-37 sets out a majority of the situations under which an applicant can get their record legally sealed. 

Arrest records in dropped or dismissed cases occurring on or after July 1, 2013, are automatically restricted, but the process is not automatic for records predating that point. In such instances, the applicant must submit a formal request to the Sheriff's Office. Cases that resulted in acquittal on all counts may also be automatically sealed. 

In addition, pursuant to the Second Chance Act, individuals can petition the court to restrict two misdemeanor convictions during their lifetime. Eligibility is exclusive to people who have completed their full sentence and have had no new arrests or convictions for at least four years. Felons are generally not eligible for record restriction under this Act. 

Lastly, individuals who have not previously committed a felony offense may get their arrest records automatically restricted if they plead or have pleaded guilty under the First Offender Act (O.C.G.A. § 42-8-60 et seq.) and complete their sentence without any new trouble. 

How Do You Remove Bibb County Arrest Records From the Internet?

While official law enforcement and court databases remove an arrest record in due course once the record has been legally restricted, commercial websites may not be as timely. However, the Georgia Mugshot Law (O.C.G.A. § 10-1-393.5) requires these companies to remove such information at no cost. 

To compel a removal, the individual must send a letter to the website through certified mail and request a return receipt. The letter must include a full name, date of birth, date of arrest, and the arresting agency. The sender may also include official proof of record restriction. 

Such websites are required by law to remove the arrest record within 30 days of receiving a valid letter.
